Please note: if your company opts not to hire a candidate because he or she is not qualified, not the best suited candidate for the position, lacking in necessary credentials, or any other reason that is unrelated to his or her background report, you are NOT required to follow the procedures outlined below. You should only follow these procedures if your decision was based on information in the report provided by ERS.
If you decide not to hire a job candidate based on information provided by ERS, you must inform the candidate in writing. You are not obligated to disclose which specific information influenced your decision. You must provide the candidate with ERS.s name, address and telephone number and inform him of his right to obtain a free copy of his consumer report from ERS within 60 days. You must also inform him that he should contact ERS with any disputes regarding information contained in the report.
ERS provides our customers with an adverse action letter that can be modified to reflect your company.s message. Using this form helps to ensure compliance with the Fair Credit Reporting Act. The form, along with the Federal Trade Commission.s document, .A Summary of Your Rights Under the Fair Credit Reporting Act,. are available on the ERSnet client log-in screen under the .Forms. link.
