What should my company do to remain compliant with the law?

Before ERS can conduct a background check on an individual, he must sign an authorization form. This document must inform him that an investigation will be conducted, must state specifically what types of information will be gathered, and must inform him of his rights under the law. Your company.s legal department can produce this simple form, or ERS can provide you with a template that can be modified to apply to your company. To obtain this form from ERS, go to the client log-on screen and click on the .Forms. link.

If your company chooses not to hire an individual and that decision is based on information in the investigative report provided by ERS, your company will need to follow the proper procedure for Adverse Action. Read on.
